Equitable Interest Disclosure
Texas Property Code §5.086
DealFlow Source facilitates transactions in which a buyer acquires equitable interest in real property prior to closing legal title. In accordance with Texas Property Code §5.086:
- The buyer is acquiring an equitable interest in the property, not legal title, until the closing of the transaction.
- The seller retains legal title to the property until the transaction closes.
- The buyer has the right to purchase the property under the terms of the assignment or purchase agreement.
- If the buyer does not perform under the agreement, the buyer may forfeit any earnest money or deposit paid.
All parties are encouraged to consult with legal counsel of their choice before entering into any agreement involving equitable interest in real property.
